Role of Constitutional Court in strengthening rule of law in Kazakhstan

In 2025, the Republic of Kazakhstan marks the 30th anniversary of its Constitution, adopted on August 30, 1995,El.kz reports.
This Fundamental Law became a cornerstone in the formation of a democratic, legal, and socially oriented state. One of the key institutions ensuring the protection of citizens’ rights is the Constitutional Court of Kazakhstan. Its activities play an important role in strengthening the rule of law, maintaining the balance between branches of power, and safeguarding fundamental human rights and freedoms.
The Constitutional Court: The Guardian of Constitutional Supremacy
Re-established as a result of the 2022 constitutional reform, the Constitutional Court of Kazakhstan has become an essential mechanism for ensuring the supremacy of the Constitution.
The Court reviews appeals from citizens, state bodies, and public organizations, verifying the compliance of legal acts with the Fundamental Law. This not only protects citizens’ rights but also helps maintain the stability of the legal system.
As noted by Mr Asan Eskendirov, Judge of the Constitutional Court “the contribution of the body of constitutional control to ensuring the supremacy of the Constitution is highly significant.”
According to him, citizens who appeal to the Court receive fair decisions that often change their life situations.
30th Anniversary of the Constitution
To mark the 30th anniversary of the Constitution, the Presidential Center, with the support of the Constitutional Court, opened the exhibition “Renewed Constitution – A Guarantee of a Just Society.”
It features about 150 exhibits, including archival documents, museum materials, and editions of the Fundamental Law in Kazakh and Russian, also published in Braille. These unique editions, prepared in cooperation with the OSCE Program Office in Astana, symbolize the state’s commitment to ensuring legal accessibility for all categories of citizens.
The exhibition reflects the evolution of constitutionalism in Kazakhstan, beginning with the adoption of the 1995 Constitution, which laid the foundations for democratization, strengthened the role of Parliament, increased the Government’s accountability, and expanded opportunities for the protection of citizens’ rights. As emphasized by Constitutional Court Judge Sergey Udartsev, a member of the working group on constitutional amendments, “The renewed 1995 Constitution supported the development of democratization of electoral law, strengthened the role of Parliament, created more opportunities for governmental initiative while increasing its accountability, enhanced the potential of legislative regulation for fairer access of the people to natural resources, reopened access for citizens to the re-established Constitutional Court, and overall reinforced the human rights protection mechanism.”
The Role of the Constitutional Court in protecting rights and freedoms
The Constitutional Court plays a key role in ensuring the human rights protection system. Citizens gained the right to directly appeal to the Court to defend their constitutional rights, which became an important step in strengthening the rule of law. The Court reviews the compliance of laws, by-laws, and international treaties with the Constitution, thereby contributing to the balance between state institutions and the protection of citizens’ interests.
