The Office of the Procurator-General of the Republic of Kazakhstan is actively developing international cooperation with foreign States in combating crime and ensuring the inevitability of punishment. At the same time, a considerable amount of work is carried out in such an important direction as extradition, which, as a legal institution, most significantly affects the constitutional rights of citizens, El.kz reports with reference to the press service of the Prosecutor’s General Office.
In accordance with the legislation of the Republic of Kazakhstan, the extradition procedure includes the arrest of a wanted person, the application of temporary detention in custody for 40 days with the sanction of the court, and then extradition arrest for a period of 12 months. During this time, an extradition check is carried out in respect of the person in custody and a decision is taken on the possibility of his extradition to a foreign State.
At the same time, the competence of the Prosecutor General's Office includes the issues of making decisions on the extradition of wanted persons. In particular, in 2022, we considered more than 90 requests from foreign states for extradition, of which 80 were satisfied.
According to the categories of crimes, persons are extradited mainly for fraud, theft, murder, drug trafficking.
