Kazakhstan introduces Digital Code

Kazakhstan has adopted the Digital Code, a fundamental legal document that establishes a unified and systematic approach to the development of digital technologies, the implementation of artificial intelligence, and the creation of a secure digital environment. The signing of the Code marks the country’s transition from digital solutions to comprehensive digital transformation based on the principles of responsibility, security, and the human rights protection, El.kz cites the press service of the Ministry of AI and Digital Development of the Republic of Kazakhstan.

Transition to systemic digitalization

The document lays the basic legal foundation for the coordinated implementation, integration, and standardization of digital solutions, including AI-based technologies.

“The adoption of the Digital Code establishes a comprehensive legal framework for sustainable and secure digital development in Kazakhstan, ensuring a balance between innovation, AI use, and protection of citizens’ rights,” the Ministry said.

Digital rights of citizens

For the first time, human digital rights are enshrined at a comprehensive legislative level. Citizens are guaranteed the right to delete their personal data, anonymize it, and restrict its processing. The use of biometric identification is permitted only in cases explicitly provided by law, strengthening privacy protection in the digital environment.

A separate provision introduces the right to review decisions made using algorithmic and automated systems with the involvement of authorized specialists, ensuring transparency and accountability of digital and AI-driven solutions that may affect citizens’ rights and legitimate interests.

New fomats of digital documents

The Digital Code expands the legal regulation of electronic interactions. In addition to electronic documents, it introduces concepts such as digital documents, digital information, and digital confirmations. Confirmations may include one-time identifiers, codes, push notifications, or biometric methods, simplifying the delivery of services and interactions between citizens, the state, and businesses.

The legal status of national digital assets is also established. These assets are subject to special legal protection by the state.

Legal framework for new technologies

The document sets the legal conditions for the use of modern technological solutions, including smart contracts, distributed systems, and digital condominiums. This creates additional opportunities to enhance the mobility of citizens and businesses and to develop digital services across various economic sectors.

For the first time in the country, a platform for the exchange and circulation of digital data products is being introduced. It is designed to ensure transparent rules for access, use, and data exchange among participants in the digital ecosystem.

Mandatory digital transformation of State

Digital transformation is established as a mandatory process for government bodies, state legal entities, and quasi-state sector organizations. These entities will annually develop and implement digital transformation programs, with achieved results serving as one of the indicators of their performance.

Cybersecurity and technology accessibility

A separate section of the Code addresses cybersecurity. The Digital Code introduces new standards for protecting digital assets, data, and infrastructure, aimed at reducing cyber risk and increasing the resilience of digital systems.

The document also includes measures to ensure the accessibility of digital technologies and services for people with disabilities and individuals with limited mobility, expanding inclusivity in the digital environment.
